Sanctions or Penalties
The good news is that just like DUI charges, BUI charges are often filed against people who have been falsely arrested or unjustly accused of this crime. Therefore, it is advisable to consult with an attorney who has experience with California BUI laws immediately after your arrest.
Boating under the influence is codified as an offense in California ports and Navigation Code 655. Under this section, there are various laws that regulate boating and drinking.
Unlike California laws that regulate drinking and driving, you are permitted to have open alcohol containers on a boat. Both passengers and operators of boats and other watercraft are allowed to have and consume alcohol. The law is only violated if you operate watercraft while under the influence.
