To “possess a destructive device” is a crime. These devices include: bombs, grenades, missiles, projectiles, rockets, or any other explosive material. This law is harsh because possessing one of these devices is itself a crime — you do not need to have intended to explode or use it.
However, to be guilty under the law in California, you must have known that:
- You possessed the device, and
- You knew that it was destructive
Under the explosives possession law, this is a wobbler — meaning it may be charged either as a misdemeanor or felony depending on your criminal history and the circumstances.
Penalties
If charged as a misdemeanor:
- Up to 1 year in county jail and/or a fine of up to $1,000
If charged as a felony:
- 16 months, 2 or 3 years in state prison, and/or a fine of up to $10,000
