False Emergency Report | California Penal Code 148.3 PC
Legal Definition
Any person who reports or makes a false emergency call is guilty of a misdemeanor but shall be punished by imprisonment in a county jail for a period not exceeding one year or by a fine not exceeding one thousand dollars ($1,000).
An “emergency” is defined as: GUNSHOTS, BUILDING EVACUATION, ETC.
But if the false alarm results in someone suffering serious bodily injury or death, then the offense becomes a felony under California law. As such, the judge may sentence the defendant to up to 3 years in prison.
You may have acted in good faith and believed there was a real emergency. Or it may have been someone else who made the false alarm and you were blamed, but do not despair — our attorneys at Progresso Legal Group P.C. will provide you with the right help.
