The crime of unauthorized practice of law in California is less well known. Many people are not aware that practicing law, or representing oneself as a lawyer \u2014 without active membership or other authorization \u2014 can lead to serious criminal sanctions in California.\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1d3da74 elementor-widget elementor-widget-heading\" data-id=\"1d3da74\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Penalties\n<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-df3844e elementor-widget elementor-widget-text-editor\" data-id=\"df3844e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The penalties for unauthorized practice of law in California under Business and Professions Code 6126 are surprisingly severe.\u00a0 A non-lawyer who presents themselves as an attorney, or practices law, faces misdemeanor penalties in California. These may include a fine of up to one thousand dollars ($1,000), up to one (1) year in county jail, or both. And the penalties are even more pronounced for former attorneys whose membership card for the State Bar is \u201cinactive\u201d or whose membership has been suspended.\u00a0 What this means is that you can be charged with either a misdemeanor or a felony.
