Definition
It refers to any conduct that disrespects or interferes with the judicial process.
If the accident results in minor injuries, such as neck pain, back pain, or soft tissue injuries, misdemeanor charges may be filed. For example, if a driver flees the scene after a minor crash and the other party complains of neck pain, they could face misdemeanor hit-and-run charges.
To better understand the concept of Contempt of Court we will give some examples of Contempt of Court:
- Speaking loudly or belligerently
- Refusing to take an oath as a witness and/or refusing to comply with the judge’s requests during any court proceeding
- Intentionally disobeying a court order. It is this last example that tends to bring about the greatest penalties
Penalties or Sanctions
For the most part, contempt of court (including violations of court orders) is a misdemeanor, punishable by up to six months in county jail and a maximum of $1,000 fine. That said, there are situations that call for more severe penalties, such as higher fines and up to one year in county jail and/or possible state prison.
There are a number of legal defenses that can be applied to crimes under Penal Code 166 PC. And fortunately the attorneys at Progresso Legal Group P.C. have the experience to represent you.
