In California the stalking law is considered among the toughest and most comprehensive in the nation. Stalking is defined, in its simplest form, as:

Following, harassing, or threatening

Another person to the point that they are afraid for themselves or for the safety of themselves/their family.

Some examples of behavior that may lead to California stalking charges include:

  • Sending frequent emails to an ex-girlfriend threatening to make her life “a living hell”

  • Following a coworker home from work every night at the same time and occasionally making threatening statements to him at the office.

Frequently sending flowers to an acquaintance, accompanied by notes

Penalties:

Penalties for the crime of stalking in California are surprisingly harsh. The crime is usually a “wobbler,” meaning that a prosecutor has discretion to try it as a misdemeanor or a felony. And, when it involves prior offenses (such as a previous stalking conviction), it must be charged as a felony.

The maximum penalties for felony stalking in California may include up to five (5) years in prison and in some cases even the requirement to register as a sex offender.

Legal Defenses

Although stalking is a very serious crime, cases are often brought on the basis of false accusations made out of revenge or other motives. Progresso Legal Group P.C. attorneys are available to help you or at least significantly reduce the charges.
