Arrest Warrants
An Arrest Warrant (Bench Warrant, Arrest Warrant, Warrant) is the most common of detention orders issued by a judge. There are various reasons a judge issues a Warrant of Apprehension or Arrest:
- Failure to Appear at a Court Hearing (FTA, for its acronym in English “Failure to Appear”) on the date you were required to appear
- Failure to present proof of community service or failure to pay a fine
- Failure to appear before the court when having an open case (i.e. failing to appear before your case is resolved)
- Failure to appear on the day of your Sentencing or Conviction (i.e. when the warrant of detention is issued after the trial or after the accused has pled guilty, but before sentence has been imposed).
A Judicial Arrest Warrant empowers law enforcement authorities to arrest an accused and bring them before a judge. If you believe you have a pending arrest warrant in California, you have the obligation to return to the court immediately, and until you do, you run the risk at any moment that the police will arrest you and bring you before a judge.
An Arrest Warrant is different from a Writ of Capture. In an Arrest Warrant, law enforcement obtains a formal document signed by a judge ordering the arrest of a person. An Arrest Warrant is issued after an investigation carried out by law enforcement through which they have reasonable suspicion (probable cause) to believe that a crime has been committed and that a certain individual (the accused) committed it. An Arrest Warrant authorizes law enforcement to arrest the individual. In most situations, people may not know that a Warrant exists until the police arrest them. In some cases, law enforcement officers may come to your workplace or home and arrest you there.
