Definition and Penalties
Bribery is broadly defined in California law, and occurs when a judge or jury makes an official decision in a case in exchange for money or something of value.
Bribery goes both ways. A person can be convicted for offering a bribe to a judicial officer, and a judicial officer can be convicted for asking for a bribe.
Under California Penal Code Section 92, offers to bribe persons responsible for deciding judicial matters are covered. PC 92 makes it a felony.
Any person who gives or offers to give something of value to a judicial officer, with intent to corrupt, in order to influence the official’s decision in an official matter.
The following persons are covered under Penal Code 92 PC:
- Judges
- Jury Members
- Arbitrators
If convicted of bribery in violation of PC 92 or PC 93, you could:
- Be incarcerated
- Pay a fine between 2,000 and 10,000
