Definition of Sanctions or Penalties
California Penal Code 25400 PC makes it a crime to carry a concealed firearm on your person or in a vehicle. This charge is separate and distinct from:
- Penal Code 25.850 PC, the California law against carrying a loaded firearm
- Penal Code 26350 PC, carrying a firearm openly in public
Penal Code 25400 PC punishes anyone who carries a concealed firearm. If you are carrying a firearm openly, you are not guilty of violating this particular law.
However, you can be liable under Penal Code 26350. Penal Code 26350 is a crime to carry a firearm openly exposed and unloaded outside a vehicle in a public place.
If the firearm is partially concealed, you could be held responsible for carrying a concealed firearm. This is so even if the firearm is identifiable. Most of California’s gun laws, including this one, require that you know of the presence of a firearm. This is to avoid people being unjustly convicted of crimes they did not intentionally commit.
