Legal Definition
This law states that “Any person who, without authority, intentionally disturbs any assembly or meeting which is not illegal; shall be guilty of a misdemeanor.”
The First Amendment gives the right to freedom of speech and peaceful assembly. It also gives police enormous power and discretion to decide that certain forms of protest are illegal.
Therefore, courts have said that it is only a crime to disturb a meeting if the defendant deliberately impairs the function of the meeting. Also, the nature of the disturbance must be in the conduct of the defendant, NOT their message.
