Possession of Tools to Commit Theft | Penal Code 466 PC
Penal Code 466 PC prohibits possessing tools of theft when done with criminal intent. “Tools of Theft” are only those tools that are used to commit a theft. These tools include instruments such as:
- A screwdriver, pliers, plug tags, or any other tool to commit a theft.
Sanctions or Penalties
The penalties for illegal possession of tools to commit theft, as a misdemeanor, may be:
- Up to six months in county jail and a maximum of $1,000 fine.
If you are found guilty of possessing theft tools and burglary, the judge “holds” the sentence for the possession charge and instead only impose the sentence for the theft.
Legal Defenses
If you can prove that you were not going to use the tools to commit a crime, the tools were not of the type prohibited by Penal Code 466 PC, and/or the police discovered the tools during an illegal search, you should be acquitted of this crime.
