Legal Definition

The unauthorized practice of medicine is a crime in California. 

California law prohibits the following activities if carried out without a valid professional license:

  • Practicing or attempting to practice or advertising oneself as practicing any treatment of a disease.

  • Diagnosing, giving treatment, operating, or prescribing for any physical or mental condition.

  • Participating in a conspiracy to—or aiding and instigating another person to—do any of those things.

Penalties

The penalties for the unauthorized practice of medicine are quite serious. 

This means that it may be prosecuted as a misdemeanor in California or a felony in California, depending on the circumstances of the case. 

Possible penalties for misdemeanors are up to one (1) year in county jail and/or a fine of up to one thousand dollars ($1,000).
Possible penalties for felonies are sixteen (16) months, two (2) years or three (3) years in prison and/or a fine of up to ten thousand dollars ($10,000). 

In addition, beyond any criminal penalties, there may be professional discipline if you are a licensed medical professional and are accused of having violated the terms of your license.
